These Terms of Service apply when you visit crossborderhk.com, contact CrossBorderHK (the GBA Transfer brand, referred to as “we”, “us” or “our”), request a quote, pay a deposit or use our cross-border private-car and coordination services. Before submitting a booking or payment, also read the Disclaimer and Privacy Policy. If a formal quote, booking confirmation or written agreement conflicts with these terms, the more specific written document controls.
1. Service and confirmation
We provide cross-border private-car transfers, charter services, local-assistance coordination and related customer support. Routes, prices, images, timings and descriptions on the website are for information and initial enquiries. They are not an acceptance of an order and do not guarantee a particular vehicle, driver, checkpoint or immigration result.
A trip is treated as confirmed only after we have clearly confirmed in writing, by a formal quote, booking confirmation or support message, the origin and destination, date and time, vehicle or seating arrangement, service scope, price and currency, payment arrangement and known additional charges. A quick support reply is not automatically a booking confirmation.
2. Routes, vehicles and checkpoints
Cross-border travel is affected by vehicle licences, insurance scope, checkpoint rules, traffic, weather, government arrangements and on-site enforcement. We will use reasonable efforts to confirm the vehicle and checkpoint plan for your booking, but cannot guarantee clearance at any particular time, no queue, no diversion or arrival at an exact time.
Unless a quote expressly includes it, charter service does not include licensed guiding, translation, admission tickets, meals, hotels, baggage forwarding, medical care, customs brokerage or another service not listed in the booking. Whether a vehicle may enter, stop or wait at a particular location is subject to local rules and the driver’s on-site judgment.
3. Your information and responsibilities
You must provide accurate, complete and timely information about your name, contact details, origin, destination, date, time, passenger count, luggage and special requirements, and promptly tell us about changes. You are responsible for valid passports, visas, permits, child documents, customs declarations and other border documents, and for complying with the laws of Hong Kong, Mainland China, Macau and the places on your route.
We are not an immigration, customs, tax, medical or insurance adviser. Delays, refusal of entry, fines, detention or extra costs caused by documents, visas, declarations, luggage, health conditions or passenger conduct are not outcomes that the vehicle service guarantees.
4. Prices, quotes and payment
Public website prices are generally starting prices for a specified route and vehicle condition. The final amount is the amount in the formal quote or booking confirmation. Before payment, the applicable currency, deposit/full payment, balance, tolls, parking, waiting, diversion, night-time and other charges should be stated.
The website may offer a HKD 200 deposit, route full payment or custom-amount payment. Payment is processed by third parties such as Stripe or PayPal. A successful payment does not mean every trip detail has completed manual confirmation; we reconcile payment using contact details, booking information and provider references.
If the trip, passenger count, amount or payment method changes before payment, contact support first rather than paying an amount that does not match the latest quote. An extra charge is not agreed unless we have confirmed it in writing.
5. Changes and cancellation
The change, cancellation, waiting and late-arrival arrangements for an order should be explained in writing by support before payment based on that trip. If you did not receive clear written conditions, ask through the Support page before paying; do not make a decision based only on a public starting price or an informal chat estimate.
Tell us as early as possible about flight changes, document problems, passenger changes, cancellation or lateness. We will consider vehicle dispatch status, driver waiting, third-party costs, payment-provider rules and the order terms. If we cannot provide a confirmed core service, we will contact you about an alternative or handle the matter under the applicable written terms.
6. Passenger safety and conduct
Passengers must follow reasonable driver instructions about boarding, seat belts, child seats, luggage and vehicle safety. You must not smoke in the vehicle, carry prohibited items, damage the vehicle, harass the driver or other passengers, or ask a driver to breach traffic, checkpoint, licensing or insurance rules.
To the extent permitted by law and the order terms, we may seek the actual cost of vehicle damage, cleaning, fines, impoundment, delay or third-party claims caused by a passenger’s intentional or negligent conduct.
7. Delays, force majeure and third-party services
Traffic accidents, severe weather, checkpoint congestion or closure, government restrictions, public-health events, strikes, vehicle faults, payment-provider failures, communications outages and other events beyond reasonable control may affect the service. We will notify you and assist with a change or alternative where practicable, but cannot guarantee that all resulting loss will be avoided.
Drivers, vehicle operators, payment institutions, map services, communications tools, hotels, airlines and other third parties may have separate terms and privacy policies. We do not give a guarantee for a third party beyond that provider’s written commitment; third-party service issues should also be raised with that provider.
8. Website content and intellectual property
Text, images, marks, logos, data compilations and page designs on the website belong to us or the relevant rights holder. You may browse and save information for personal enquiry and booking purposes, but may not copy, scrape, republish, impersonate or use it for commercial competition without permission.
We try to keep content accurate and current, but routes, prices, checkpoints, vehicles and rules can change. Use the latest formal written confirmation and requirements from the relevant authorities before travelling.
9. Liability
To the maximum extent permitted by applicable law, we are not responsible for indirect loss, lost profit, a missed flight or event, visa or clearance results, third-party failures or unconfirmed arrangements that we could not reasonably control. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including fraud, wilful misconduct or legally non-excludable personal injury liability.
Subject to the previous paragraph, our recoverable liability for a paid booking is capped at the service amount actually paid to us for that booking, unless mandatory law requires a higher amount.
10. Changes and governing law
We may update these terms when our service, technology or legal obligations change. The updated version applies to new enquiries and bookings; confirmed bookings remain subject to their confirmation documents. Unless the booking or mandatory consumer law says otherwise, these terms are governed by the laws of the Hong Kong Special Administrative Region and disputes may be handled by the courts of Hong Kong. Mandatory consumer rights in your location are not excluded.
